This is the article I always looked forward to writing.... In an extraordinary and historic ruling, the judge presiding over the case of Capt Juan Gale has dismissed all charges with prejudice, bringing an end to this long and exhausting legal battle. This decision is a monumental victory for justice, integrity, and the fundamental rights of all individuals within the military justice system.
The dismissal with prejudice means that the case against Capt Gale cannot be refiled, effectively clearing his name and restoring his honor. This ruling not only vindicates Juan but also highlights the importance of holding the USAF and Command accountable to the principles of fairness and justice.
The decision was based on the following key points:
Reevaluation of Prior Rulings: The court reconsidered rulings made by Maj Tiny Bowman, who recused herself after issuing decisions that could be seen as biased due to their timing. The judge decided it was in the interest of justice to review these decisions independently.
Improper Withdrawal of Charges: The convening authority, then Maj Gen Michael Koscheski, improperly withdrew the original charges against Capt Gale. This action either intentionally or unintentionally interfered with the impartiality of the court. Even if the interference was not deliberate, it could have created the appearance of bias, undermining confidence in the military justice system.
Unfair Prejudice to Gale: The improper withdrawal and re-filing of the same charges caused significant harm to Capt Gale. He lost the benefit of a favorable ruling from the original judge, faced delays in his trial (over 18 months), and experienced a disruption in the fairness of the process.
Extraordinary Remedy: The judge ruled that the only way to address the harm caused by these actions was to dismiss the charges with prejudice. Dismissing without prejudice would allow the charges to be refiled, further perpetuating the unfairness Capt Gale endured.
Key Takeaway
The court found that the improper actions and procedural mishandling made a fair trial impossible. The dismissal with prejudice is an extraordinary outcome, reflecting the seriousness of the misconduct and its impact on Gale’s rights. The judge’s decision reflects a deep commitment to upholding the rule of law. These findings exposed systemic failures within the chain of command and JAG.
Gratitude and Reflection
The Gale family extends their heartfelt gratitude to the thousands of supporters who stood by Juan during this trying time. Your unwavering faith, public testimonials, and acts of kindness have been a source of strength and hope.
To the judge, the Gale family expresses profound respect and appreciation for the courage and wisdom demonstrated in this ruling. This decision not only safeguards Juan Gale’s future but also ensures that the military justice system can learn and grow from these failures.
This victory could not have been achieved without the tireless efforts of Attorney Aaron Meyer and Capt Rogers, whose dedication to Juan’s defense has been unwavering. Their meticulous work, legal expertise, and commitment to truth were instrumental in ensuring this just outcome. The Gale family extends their deepest gratitude to both for their extraordinary advocacy.
Moving Forward
This ruling is a powerful reminder that justice can prevail even in the face of adversity. The Gale family remains steadfast in their hope that the lessons learned from this case will inspire meaningful reforms and prevent others from enduring similar injustices.
Thank you to everyone who has walked this journey with Juan and his family. Your prayers, advocacy, and belief in justice have made this extraordinary outcome possible.
The family is still processing this news but issued a brief statement saying: "We give all the glory and thanks to God, for equipping this judge with the knowledge and courage to operate in the interest of justice, and for providing Juan with the strength to fight this battle. We could not be more grateful and overcome with joy."
As a reminder, when all of the court documents are ready, J4JG will publish all public documents and filings for the public to read. Stay tuned for additional updates and news regarding this case.

Reading everything took time to piece together, but it all boils down to three glaring variables: Higashi, JAG, and false accusations.
This isn’t just a case of poor judgment—it’s outright criminal behavior. Higashi and JAG deliberately conspired to unlawfully take advantage of Captain Gale, using intimidation tactics based on false accusations. But when Gale called their bluff, they panicked. Instead of coming clean, they roped in higher command, likely thinking this would shield them. Instead, it dragged more leaders into this web of misconduct, exposing even deeper failures.
This is not just troubling—it’s a four-year nightmare of evidence showing command prioritizing their own interests over the law and the people they are sworn to protect. This is systemic corruption, and it must be…
I’m relieved for Capt Gale, but I am seething with rage at JAG, Col Coyle, Maj Gen Koscheski, Lt Col Higashi, and Col Voigt for their despicable actions. These so-called leaders deliberately weaponized their authority to destroy a man’s life, assuming their rank and power would shield them from accountability. Their blatant corruption and abuse of the justice system expose a terrifying reality: if they could do this to Capt Gale, they can do it to anyone. How can current and future service members trust a system that allows predators like these to operate unchecked? This victory shows they were wrong this time, but it’s not enough. They must be held to account, stripped of their positions, and face the…
To Keven P Coyle, Richard Higashi, Michael G Koscheski, Kenneth J Voigt, Janet Eberle, William McCormick, Melissa B Lopes, Tiny Bowman - you have disgraced the airforce, your families, your bases and this country! Your careers might continue but your name will forever be tarnished and stained with controversy and questionable ethics. 10% huh Coyle?
To the USAF - shame on you for allowing nearly four years of Gales life to be taken and forced him to literally fight for his life due to EGO and public perception.
To the people who didn’t believe in Gale and turned their backs - shame on you! This could be you some day! This could be your brother, sister, spouse, child.
To social…
It’s sad that so many people at tinker had the chance to fix this and do right by Gale, but chose to take the cowardly way out and turn a blind eye because they didn’t want to get involved and risk themselves. We know who you are, you know who you are and God knows who you are. Makes me scared for my own spouse at tinker 552.
The fact that anyone is afraid to stand up and do what’s right is the main issue here.
This victory for Capt Gale is long overdue, but it doesn’t erase the rage I feel toward JAG, Col Coyle, Maj Gen Koscheski, Lt Col Higashi, and Col Voigt. These individuals are nothing short of cowards who abused their power, lied, and manipulated the system to ruin an innocent man’s life. Their actions are a slap in the face to every military family who trusts the system to be fair and just. They don’t just need to be stripped of their ranks—they need to be publicly shamed, prosecuted, and held accountable for the irreparable harm they caused!
