No Decision from Judge: Where Do We Stand?

As we approach the new year, the case of Juan Gale remains a troubling example of the challenges within our military justice system. For those following this case closely, we know it is more than just legal arguments and court schedules; it’s a fight for justice, integrity, and the future of a young man whose rights have been repeatedly tested.


On September 8th of this year, a pivotal hearing took place, during which key motions were presented before the judge. The defense outlined a series of grave concerns, beginning with motions to compel the submission of critical evidence and testimony from witnesses. It was revealed during this hearing that Holderbland and Soto, key individuals in the case, admitted to withholding messages and evidence that may be crucial to the defense.


The defense further argued for a motion to dismiss, citing unlawful command influence (UCI) and prosecutorial misconduct. These claims are supported by evidence showing inappropriate actions by commanders and JAG, undermining the fairness of the proceedings. Additionally, a motion was filed for violation of Juan’s right to a speedy trial—a cornerstone of justice that has been systematically ignored, extending this case for nearly four years. 


In response to these motions, the judge canceled the subsequent week of court martial proceedings and has spent the months since September 9th reviewing these critical arguments. Now, with the tentative court martial date set for January 13th, the stakes couldn’t be higher. The fact that the judge has been reviewing the motions since September 9th - more than 110 days ago - suggests the weight of the issue and the potential long-term implications of the ruling. 


The Path Ahead: Justice in the Balance

The judge’s decision, expected by January 13th, will determine the trajectory of this case. Two potential scenarios loom:


  1. Dismissal with Prejudice The defense, the Gale family, and supporters pray for a dismissal with prejudice. Such a decision would hold those responsible for misconduct accountable, including commanders implicated in unlawful command influence and prosecutors who violated Juan’s right to a speedy trial. A dismissal would not only vindicate Juan but also send a strong message against corruption and abuse of power within the military justice system. However, this decision carries significant consequences, as high-ranking officials like Voigt, Coyle, Eberle, and Koscheski—all vying for promotions—could see their careers derailed.

  2. Denial of Defense Motions If the judge denies the motions for UCI and speedy trial violations, the case would move forward to court martial. The implications here are troubling. While the judge could grant the motion to compel evidence, doing so this late risks further delaying the case, creating logistical and ethical challenges. Conversely, a denial of the motion to compel would undermine Juan’s right to a fair trial, as critical evidence has already been admitted to exist by JAG but remains undisclosed. Such a denial would echo the injustices highlighted in the precedent-setting U.S. v. Stellano case.


Ultimately, we are left with two starkly different outcomes: either the case is dismissed with prejudice, exposing the misconduct of those in power, or it proceeds, perpetuating a gross miscarriage of justice.


Lessons from U.S. v. Stellano

The U.S. v. Stellano case serves as a stark reminder of what happens when judicial integrity is compromised. In that case, critical evidence was withheld, and procedural delays undermined the accused’s right to a fair trial. The ruling ultimately highlighted systemic failures and set a precedent for addressing prosecutorial misconduct and unlawful command influence. Similarly, in Juan Gale’s case, the withholding of communication between command and JAG and the delays in ruling on motions mirror the issues seen in Stellano. Without accountability, these injustices are bound to repeat themselves.

Anyone who has served has seen this corrupt system is aware this is to built to protect the DoD. We know performance reports are baked in lies and influence....in many cases. I hope the Judge is righteous and empowered to do the right thing.


The current military justice system is deeply influenced by command, with leadership often prioritizing self-preservation and bias—mistaken for strength—over the well-being of service members. This leaves individuals like Capt. Gale to navigate a complex and unjust system, facing significant hurdles in their pursuit of justice. Father God, I lift up Capt. Gale to You in Jesus' name, asking for Your grace, wisdom, and strength to surround him during this incredibly challenging time. I pray for the judge to be guided by Your righteousness, to be fair and unbiased, and to truly consider all the facts in this case. May they see the truth and act justly, disregarding the influence of those who have worked to distort the facts and deny Capt. Gale his due process.
